Effective date: September 22, 2026
Arbor Artis, L.L.C., operating as Misfit Boards, handles store, purchase, support, and communication information as described here. Contact care@misfitboards.com or 41 Watchung Plaza, Suite 92, Montclair, NJ 07042, United States. Independent services also have their own privacy notices.
Information we collect
The information involved depends on how you interact with us and which available features you choose:
- Contact and account information: name, email, telephone number if provided, billing and delivery addresses, and account or sign-in identifiers.
- Transaction information: products viewed or ordered, order value, purchases, returns, refunds, gift details, custom specifications, and customer-service history. Payment providers process payment details; we receive information needed to manage the transaction, such as payment status, transaction identifiers, and limited payment-method details.
- Messages and supplied content: questions, correspondence, photos of a product issue, custom artwork, and information you choose to include in a review or other available submission feature.
- Device and usage information: IP address and approximate location, browser, device and cookie identifiers, page and product views, cart activity, referrals, and interactions with store features or marketing.
- Preferences and inferences: communication preferences, privacy choices, and shopping interests inferred from activity, where used for the purposes described below.
Information comes from you, store technologies, Shopify, and providers supporting payments, delivery, security, and other functions. Gift-recipient details come from the purchaser. Provide only information you are authorized to share.
How we use information
We use information to process orders and payments; prepare custom goods; arrange delivery; maintain accounts and records; answer questions; administer returns, refunds, and warranty claims; and communicate order or safety information. We also use relevant information to identify fraud, secure the store, investigate problems, resolve disputes, and satisfy legal, tax, and accounting obligations.
We use store analytics to understand performance and improve products, navigation, and service. Subject to your choices and required consent, information can also support personalization, advertising, and measurement of marketing effectiveness. When you sign up for marketing, we use your contact details and relevant preferences to send it. Marketing consent is separate from placing an order where the law requires that distinction.
Ordinary shopping does not require government identification or health information. Avoid unnecessary sensitive details in uploads or messages. We explain any legitimate request for additional information or consent.
Shopify and Shopify Network Intelligence
Shopify hosts our store and processes personal information to provide commerce services. We have enabled Shopify Network Intelligence. Through it, Shopify uses information from interactions with our store together with information from other merchants and Shopify to support services such as analytics, personalization, and advertising. This does not mean that we exchange customer mailing lists with other merchants.
Shopify’s handling of information for its own consumer and enhanced services is described in Shopify’s Consumer Privacy Policy. You can also use Shopify’s privacy portal to exercise choices directly with Shopify. Our own privacy-request contact remains available for information we control.
Who receives information
We disclose information for the purposes above to the following categories of recipients, as relevant to the service you use:
- Shopify and commerce, hosting, security, payment, fraud-prevention, and technical-service providers.
- Delivery and fulfillment providers, including USPS or UPS, that need information to ship and support an order.
- Providers supporting communications, customer service, analytics, and available store features, and professional advisers such as accountants or legal counsel when reasonably necessary.
- Advertising and measurement partners, including Shopify when it supplies those services, subject to applicable consent and opt-out choices.
- Public viewers, when you deliberately post a review or other public content, and a person you authorize us to share information with.
Necessary disclosures may also support legal compliance, valid legal process, security, legal claims, or a safeguarded business sale or reorganization. We require appropriate protections from providers acting for us. Independent provider activities are also governed by their own notices and legal duties.
Advertising disclosures and customer lists
We do not sell or rent customer mailing lists for money or exchange them with other businesses for their separate mailing lists. However, disclosures of identifiers, device activity, browsing information, or shopping interests for advertising can be treated as a “sale,” “sharing,” or “targeted advertising” under certain state privacy laws, even when no money is paid for the information. Shopify Network Intelligence can involve this kind of processing.
You can opt out of covered advertising disclosures through Your Privacy Choices: https://www.misfitboards.com/pages/data-sharing-opt-out , or email care@misfitboards.com with your request. Opting out of advertising disclosures does not prevent information needed for a payment, shipment, security, or other permitted store function from being processed.
Cookies and browser choices
We and providers including Shopify use cookies, pixels, and similar technologies for essential store functions and, subject to your choices and required consent, analytics, personalization, and advertising. Third parties providing these services may collect information about activity over time and across websites or services. Cookie settings and Your Privacy Choices, available through our store, let you manage the choices offered for your visit.
We honor recognized opt-out preference signals, including Global Privacy Control, for covered sale, sharing, and targeted-advertising processing as required by applicable law. Where we can appropriately associate a signal with an account and the law requires it, we apply the choice accordingly. Legacy browser “Do Not Track” settings are different; we do not otherwise alter our practices solely in response to those settings.
Some choices are browser- or device-specific. You may need to repeat a choice on another device or after clearing cookies. Blocking essential cookies can affect checkout or account functionality. A cookie choice does not automatically unsubscribe you from email or text marketing.
Marketing choices
Unsubscribe from promotional email through its link or care@misfitboards.com. Necessary transaction, safety, and legal messages may continue. If you separately enroll in text marketing, its terms explain consent and withdrawal. A delivery telephone number alone does not enroll you in promotional texts.
Access correction deletion and other rights
Depending on where you live and whether the relevant law applies, you may have rights to access or receive a copy of personal information, correct inaccuracies, request deletion, obtain information about disclosures, opt out of certain advertising uses, or exercise other rights concerning sensitive information or legally significant automated decisions. These rights can have lawful exceptions; for example, we may need transaction records to comply with tax law or address a dispute.
Request help through care@misfitboards.com or our mailing address, identifying the request and relevant records. No account is required; available account controls can also correct information. We proportionately verify identity where needed for access, correction, or deletion, without demanding unnecessary identity documents for advertising opt-outs.
An authorized agent may submit a request with proof of authority; we may verify authorization where permitted. We meet applicable deadlines and explain permitted extensions. Access or deletion requests often have a 45-day period; your applicable deadline controls, and opt-outs may require faster action. We do not unlawfully discriminate or retaliate for exercising privacy rights.
If we deny a request, we explain the basis and any available appeal. You may ask us to reconsider by replying or emailing care@misfitboards.com with “Privacy Appeal” in the subject. We review appeals within the applicable legal period and explain the outcome. You may also contact your state attorney general or other relevant privacy regulator. Where no particular statutory right applies, you may still contact us with a privacy concern.
Retention and security
Retention depends on purpose and legal obligations: order and payment records support tax, accounting, fraud, and legal needs; support and warranty records document claims; account and marketing records reflect the relationship and your choices, including opt-outs; technical records support security and analytics. We delete or deidentify information when no longer needed, subject to lawful holds and reasonable backup processes.
We use reasonable administrative, technical, and organizational safeguards. No online system is completely secure; this does not waive our legal responsibility to protect information.
Children and international processing
This adult-oriented store is not directed to children under 13. We do not knowingly collect their information without required authorization. Report concerns to care@misfitboards.com. We do not knowingly sell or share information of children under 16 for advertising without legally required authorization.
Shopify and other providers may process information in the United States and other countries with different privacy laws. We use legally required transfer safeguards. Our limited physical delivery area does not eliminate privacy rights that otherwise apply.
Changes to this policy
We post updates with a revised effective date. For material changes, we give additional notice through the site or email and obtain any required consent, including for materially inconsistent new uses of previously collected information. Contact us with policy questions.
